Rules & regulations
ENTRY
- The 2010 Explore Newfoundland Contest (the “Contest”) is sponsored by Canadian Geographic.
- No purchase is required to enter the Contest or to win the Grand Prize.
- There are two ways to enter the Contest:
- Automatic Subscription Entry: By subscribing for, or renewing, your personal or gift subscription to Canadian Geographic between January 1, 2010 and July 2, 2010, your name will be automatically entered in the Contest. The names of donors of gift subscriptions will be entered in the Contest, not the recipients of the gift subscriptions. - Essay Entry: Legibly hand-print and mail your name, telephone number and address as well as a hand-printed original 500-word essay about “Newfoundland and Labrador” in a postage-paid envelope to: 2010 Explore Newfoundland Contest c/o Canadian Geographic, 1155 Lola Street, Suite 200, Ottawa, Ontario K1K 4C1. Upon receipt of your entry (including your name, telephone number, address and essay), your name will be entered in the Contest. Illegible, duplicate or mechanically produced or reproduced essays will not be accepted.
- Contest opens on January 1, 2010 at 12:01 am (EST) and closes on July 2, 2010 at 4:00 pm (EST) (the “Contest Period”).
- All entries (whether by way of Automatic Subscription Entry or Essay Entry) must be received on or before 4:00 pm EST July 2, 2010.
- Chances of winning the Grand Prize will depend on the number of eligible entries received in accordance with these Rules and Regulations during the Contest Period.
- Entries submitted through fraudulent means or are in any way tampered with, incorrect, unclear, forged, mutilated, illegible, indecipherable or mechanically reproduced may be disqualified at the sole discretion of Canadian Geographic.
- All entries become the property of Canadian Geographic and will not be returned.
- Canadian Geographic is not responsible for entries lost, late, misdirected, illegible or delayed for any reason, or for any postage due.
GRAND PRIZE
One Grand Prize will be awarded consisting of an adventure cruise for two aboard the 90-passenger Ocean Nova (or similar vessel) to Newfoundland and Labrador, departing from St. John’s, Newfoundland. The trip will take place from September 18 to September 28, 2010. Berths (accommodations) are category 5, Main Double, two lower berths, private facilities, desk/chair, wardrobe, picture window. Trip itinerary available at www.adventurecanada.com is subject to change.
- Prize includes: accommodation while on board the vessel, meals (with the exception of on shore meals), Zodiac excursions, service charges, port fees, applicable conservation/cultural fund fee and applicable GST associated with the prize elements listed above. The winner and travel companion must adhere to Adventure Canada rules and requirements for trip passengers such as insurance, baggage limitations and other such terms and conditions as may be required by Adventure Canada and/or described at www.adventurecanada.com.
- The contest winner and travel companion are solely responsible for all costs, fees and expenses associated with getting from the winner’s and travel companion’s home(s) to the winner’s and travel companion’s point of departure (St. John’s) and getting back home from the same city (St. John’s), as well as all other costs and expenses including: mandatory emergency medical and air evacuation insurance, travel insurance, gratuities, spending money, any applicable taxes and duties (other than GST as set out above and airport departure tax) as well as any additional expenses (including, but not limited to, laundry, alcoholic beverages, phone calls, onboard medical fees and any and all fees, costs or disbursements associated with any delays or itinerary changes).
- Approximate retail value of the prize is $CDN $14,393.13.
- The Grand Prize may not be used in conjunction with any other offer or promotion. The Grand Prize may not be sold, redeemed for cash, combined with any other promotion, exchanged for a different trip or for different departure/arrival dates or cities.
CONTEST DEADLINES
All entries (whether by way of Automatic Subscription Entry or Essay Entry) must be received on or before 4:00 pm EST July 2, 2010.
GRAND PRIZE SELECTION
- There will be one (1) random draw conducted for the Grand Prize from among all eligible entries received during the Contest Period. The draw will be conducted by Canadian Geographic personnel and held at 5:00 pm EST on July 2, 2010 at the Canadian Geographic offices located at 1155 Lola Street, Suite 200, Ottawa, Ontario.
- The selected entrant will be notified by registered mail, or by telephone no later than 5pm on July 5th, 2010, followed by a written notification. The winner has until 5:00 pm on July 19th, 2010 to confirm receipt of the Grand Prize notification and acceptance of the prize subject to these Rules and Regulations. Failure to confirm receipt of Grand Prize notification or acceptance of the Grand Prize by the stated deadline means the winner forfeits the Grand Prize and the Grand Prize will then be awarded to an alternate winner selected by random draw from all remaining eligible entries.
CONDITIONS
- To enter and be eligible to win you must be a permanent resident of Canada, of the age of majority in the province or territory which you reside, and not an employee of, a member of the immediate family of, or domiciled with an employee or Board member of any division of Canadian Geographic, The Royal Canadian Geographical Society, Adventure Canada, or an employee or Board member of their parents, subsidiaries, affiliates and agencies.
- In the event the winner and/or the winner’s travel companion is/are not eligible/able to travel on the dates specified by Canadian Geographic, and Adventure Canada is notified by July 19th, 2010, the prize may be transferred to another person of the winner’s choosing. Some restrictions may apply. Dates of departure and return are subject to change. In the event the Grand Prize is not available for any reason outside the control of Canadian Geographic, no substitution or compensation will be provided.
- The winner and travel companion must provide a physician note, acceptable to Adventure Canada, confirming the winner’s and travel companion’s ability to travel as required by Adventure Canada. Any fees or costs associated with obtaining the physician note are the sole responsibility of the winner and travel companion.
- The winner and travel companion must have valid travel documents (i.e., valid photo identification, etc.) prior to departure or the prize will be forfeited. The winner and companion are solely responsible for obtaining and/or renewing travel documents in order to travel. Canadian Geographic assumes no liability for ensuring the winner and/or travel companion are eligible/able to travel. The winner and travel companion must travel together on the same itinerary to, and from, the same departure/arrival city (St. John’s).
- By accepting the prize, the winner agrees to hold Canadian Geographic, The Royal Canadian Geographical Society and Adventure Canada and their respective agencies, affiliates, parent(s), subsidiaries, agents, advertising and promotion agencies and anyone else involved in the development, production or handling of the Contest and their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of acceptance or use of the Grand Prize, including, but not limited to, travel-related injuries and/or death. The winner and travel companion assume all liability for any injury or damage caused, or claimed to be caused, whatsoever and howsoever arising, by participation in this Contest or use or redemption of the Grand Prize.
- In order to be declared a winner, the selected entrant must:
(i) correctly answer, unaided, a time-limited, mathematical, skill-testing question to be administered by Canadian Geographic by telephone, e-mail or mail; and
(ii) sign and return a standard declaration and release form confirming compliance with Contest Rules and Regulations, consenting to the use, without further compensation, of the winner’s (and travel companion’s) name, address (city only) and photograph(s) in any Contest-related publicity and releasing Canadian Geographic, The Royal Canadian Geographical Society and Adventure Canada and their respective agencies, affiliates, parent(s), subsidiaries, agents, advertising and promotion agencies and anyone else involved in the development, production or handling of the Contest and their respective directors, officers, employees and assigns from all liability arising in connection with the Contest or the acceptance, use or redemption of the Grand Prize as awarded. The declaration and release must be returned to Canadian Geographic within ten (10) days after receipt of the declaration and release from Canadian Geographic. The winner will be contacted by Canadian Geographic to make arrangements for the conduct of the skill-testing question.
- The companion must also sign and return a release form prior to travel. If the winner’s travel companion is not of age of majority at the time the prize is awarded, the winner must provide confirmation, satisfactory to Canadian Geographic, that the companion has the consent of the companion’s parents or legal guardian to accompany the winner as well as a release form signed by the companion’s parents or legal guardian. If the companion, or parents or legal guardian, does not sign and return the release form prior to travel, the companion will not be permitted to travel and no compensation or prize substitution will be awarded.
- By entering, all entrants agree to adhere to, and abide by, these Contest Rules and Regulations. The decisions of Canadian Geographic with respect to any Contest matter are final.
- This Contest is subject to all applicable federal, provincial and municipal laws and bylaws. Contest is void where prohibited. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
